Acceptance of these terms
By accessing or using the BARYA website (https://barya.af) or engaging us for consulting or training services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the website or our services.
If you accept these terms on behalf of an organization, you represent that you have the authority to bind that organization to them.
Our services
BARYA Consulting Services provides leadership and strategic management consulting, project management advisory, and PMI-aligned training programs to organizations operating in Afghanistan and the wider region. The website serves as the primary channel for information about our services, insights, training calendar, and contact details.
Who can use our services
Our website is publicly available; our consulting and training services are intended for adults (18+) acting on behalf of organizations — businesses, NGOs, government agencies, and similar entities. By using our services you confirm you meet this requirement.
Acceptable use of the website
You agree not to:
- Use the site for any unlawful purpose or in violation of these terms.
- Attempt to gain unauthorized access to any part of the site, our servers, or systems.
- Disrupt, overload, or interfere with the operation of the site.
- Scrape, crawl, or systematically extract content from the site without our written permission.
- Misrepresent your affiliation with BARYA, or impersonate another person or organization.
- Upload viruses, malicious code, or other harmful technology.
Consulting & training engagements
Specific consulting projects and training programs are governed by a separate written engagement letter, statement of work, or training agreement. Where any conflict exists between this page and a signed engagement document, the engagement document prevails for that engagement.
Typical engagement terms cover:
- Scope of work, deliverables, and timeline.
- Roles, responsibilities, and the client's contribution to delivery.
- Fees, payment schedule, and reimbursable expenses.
- Cancellation, postponement, and substitution policies for training programs.
- Acceptance criteria for consulting deliverables.
Intellectual property
All content on this website — including text, graphics, logos, the BARYA name and brand marks, photos, and downloadable resources — is owned by or licensed to BARYA Consulting Services and is protected by applicable copyright and trademark law.
You may:
- View and read website content for personal, non-commercial use.
- Quote short passages with clear attribution to BARYA and a link back to the source page.
- Share links to our pages on social media and within your organization.
You may not, without our prior written consent:
- Reproduce, republish, or commercially distribute substantial portions of the site.
- Remove or alter copyright, trademark, or other proprietary notices.
- Use BARYA training materials, frameworks, templates, or methodologies outside the scope of a paid engagement.
PMI®, PMP®, PMBOK®, PRINCE2®, Prosci®, and other third-party marks referenced on this site are the property of their respective owners and used here for identification only.
Confidentiality
We treat client information shared with us as confidential. During a signed engagement we adhere to mutual confidentiality obligations as defined in the engagement letter. Even outside a formal engagement, we will not disclose information you share with us in good faith except where required by law or with your permission.
Fees, invoicing & taxes
Fees for consulting projects and training programs are quoted in the relevant proposal, statement of work, or program brochure. Unless stated otherwise:
- Quotes are valid for 30 days from the date of issue.
- Fees are quoted exclusive of any applicable taxes, duties, or withholding obligations, which are the client's responsibility.
- Invoices are payable within 14 calendar days of the invoice date unless otherwise agreed in writing.
- Late payments may be subject to a service charge at the maximum rate permitted by applicable law.
Disclaimers
The website and its content are provided “as is” and “as available”. While we work hard to keep information accurate and up to date, we make no warranty of completeness, fitness for a particular purpose, or uninterrupted availability.
Information on the site is general in nature. It does not constitute legal, financial, or professional advice for your specific situation. Any reliance you place on it is strictly at your own risk. Engaging BARYA for tailored advice requires a written engagement letter.
Limitation of liability
To the maximum extent permitted by applicable law, BARYA, its directors, employees, and associates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the website.
For consulting and training engagements, our aggregate liability for any claim arising out of or related to an engagement is limited to the fees paid by the client to BARYA under that specific engagement during the 12 months preceding the event giving rise to the claim, except where prohibited by law.
Termination
We may suspend or terminate your access to the website at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users, to BARYA, or to third parties. Provisions of these terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
Governing law & disputes
These terms are governed by the laws of the Islamic Emirate of Afghanistan. Any dispute arising out of or related to these terms or your use of the website will be subject to the exclusive jurisdiction of the competent courts of Kabul, Afghanistan, unless a separate engagement document provides for arbitration or another forum.
We encourage you to contact us first — most issues can be resolved quickly and informally.
Changes to these terms
We may update these Terms of Service from time to time. The “Last updated” date at the top of this page tells you when the latest revision took effect. Continued use of the website after a change means you accept the updated terms.
